Liability Waiver, Release & Assumption of Risk
Please read this waiver before your first class, workshop or guild activity. You confirm that you have read and agree to it as part of your registration.
1. Assumption of risk
Capoeira Angola is a physical martial art and cultural practice. It involves kicks, sweeps, inversions, floor work, close contact with other participants, live percussion and movement on hard surfaces. I understand that participation carries inherent risks including, without limitation, sprains, strains, fractures, dental and eye injury, concussion, heat illness, permanent disability, transmission of illness, and death. I voluntarily choose to participate with full knowledge of these risks and I assume them entirely myself.
2. Personal responsibility
I am solely responsible for my own condition, conduct and choices during any class, roda, workshop, performance, guild activity or event. I confirm that I am physically able to participate, or that I have consulted a physician. I will train within my own limits, follow the instructions of the teachers, disclose relevant injuries or medical conditions, and stop when I need to. I am responsible for my own negligence and for any harm resulting from it, to the fullest extent permitted by Texas law.
3. Release of liability
In exchange for being allowed to participate, I release, waive and discharge Medicinal Gourds LLC, Crianças de Capoeira Angola Academy, its Mestres, Professors, Contramestres, Instructors, monitors, staff, volunteers, board members, other students and participants, its affiliates and partner organizations, and the owners and operators of any facility where activities are held — including DAWA and DAWA HQ, 916 Springdale Road, Austin, Texas — from any and all claims, demands, damages, causes of action or liability of any kind arising out of or related to my participation, including claims arising from ordinary negligence, to the fullest extent permitted by law.
4. Other participants and the facility
I understand that other students and guests are independent individuals. The academy does not control and is not responsible for the acts or omissions of other participants, guests or visitors. I agree not to hold the academy, its instructors, its affiliates or the host facility responsible for injury, loss, theft or property damage caused by another participant or by conditions of the premises.
5. Indemnification
I agree to indemnify and hold harmless the parties released above from any claim, loss, damage, cost or expense, including reasonable attorney fees, brought by me or on my behalf, or brought by a third party as a result of my own acts, omissions or negligence.
6. Medical care
I authorize the academy to arrange emergency first aid or medical transport if it reasonably appears necessary, and I accept financial responsibility for any resulting cost. I understand the academy does not provide medical insurance for participants.
7. Photography and media
Classes, rodas and events may be photographed or recorded for documentation, education and promotion. I grant permission for my likeness to be used in those materials without compensation. If I do not wish to appear, I will notify the academy in writing and note it on my registration.
8. Conduct and cultural respect
Capoeira Angola is an ancestral tradition. I agree to treat the teachers, elders, students, instruments, songs and space with respect, and to follow the academy's conduct expectations. The academy may end my participation at any time for conduct that endangers or disrespects others.
9. Payment and attendance
Tuition payments are non-refundable and non-transferable unless stated otherwise. If a scheduled class is canceled by the academy, monthly tuition will be prorated or credited toward the following month.
10. Minors
If the participant is under 18, the parent or legal guardian signs on the participant's behalf, accepts every term above for that participant, and agrees to these terms individually as well.
11. Entire agreement and governing law
This waiver is governed by the laws of the State of Texas. If any part is held unenforceable, the remaining parts stay in full force. I have read this document in full, I understand it is a release of legal rights, and I sign it freely.
Signing
You may agree to this waiver directly on the registration form by typing your initials and full legal name, or print this page, sign it by hand and bring it to your first class. For participants under 18, a parent or legal guardian must sign.
